Following are some of the "Frequently Asked Questions"

Question - Are there any up front fees?

Answer - No. Our fees are recovered in your settlement. In our final proposal to you, a schedule that outlines the final cost is provided. We don't get paid until you get paid!

Question - Does my case qualify?

Answer - If you are involved in one of the following cases, you more than likely qualify based on the merits of the case.

  • Personal Injury Vehicle
  • Personal Injury Premises
  • Personal Injury Assault
  • Wrongful Death
  • Medical Malpractice

Workers Compensation - We can only invest in workers compensation if the following applies to your claim. (You may contact us or ask your attorney if the following apply.)

  1. If the state law of which the accident took place allows a lien on your case for our non-recourse advance.
  2. If you have a third party claim in addition to your workers compensation claim. What this means is, if you also have a personal injury claim against the negligence of something or someone other than your workers compensation claim. Your attorney will know if you are making a claim other than workers compensation. (I.e. You were injured on a job in which the premises where the accident took place is also liable for your injuries.)

Question - How much money can I get advanced?

Answer - Each and every case is different. However, there are in-house standards that we use to help determine how much we can advance as well as our risk. The majority of our advances include a one-time payment to you with a one-time payment for repayment. In the event that a case is expected to sustain a long duration, we may provide monthly subsistence payments. Each case is evaluated and proposed per offer.

Question - How long does it take to get my money?

Answer - Normally within 24 hours once we receive the information we need from you and your attorney.

Question - Can I really get money before my settlement?

Answer - Yes, we literally advance you against your future settlement proceeds of your lawsuit. We provide you cash now in exchange for a secured amount of any settlement or judgment that is awarded from the litigation.

Question - Why don't my attorney just advance me money?

Answer - The American Bar Association does not allow attorneys to advance money to their clients. Attorney's can only advance money for direct case expenses. This allows for protection for both you and your attorney.

Question - Can you tell me what my case might be worth or if I even need an attorney before I hire an attorney?

Answer - No, we do not provide legal advice. We maintain certain in house rules for case integrity. If we ask you a question or make a statement that your attorney has not asked or stated, it is a mere coincidence in our fact-finding procedure.

Question - How are Case Funding Values Determined?

Answer - Legal Funding Group develops its own case value underwriting tolerances. For example, the case value that we use is not necessarily a reflection of what your case may or may not settle for. A typical consideration is, 10% of the policy limit of the defendant with supporting injuries. We do not use property damage as value rating. However in some cases, we use the property damage amount to support injuries. Lost wages are considered.

Question - Is it legal to get an advance against my settlement or judgment?

Answer - Yes, as you probably have already experienced, you have signed a contingency fee agreement with your attorney as well as authorizing medical payments etc. The very same can be done for our contingency non-recourse agreement.

Question - What can I use the money for?

Answer - The money is yours to use as you wish, we prefer clients that are going to use their proceeds to pay bills or support their cases. We are a last resort financial source.

Question - Optional advance choices?

Answer - You will more than likely find that banks and other traditional sources will not advance against a pending lawsuit or claim.

Question - Does our service determine the outcome of my case?

Answer - No, we are not a law firm and we do not offer legal advice. You and your attorney work together in a normal fashion.

Question - What happens if I lose my case?

Answer - You owe us nothing if you lose your case.

Question - How do you know when my case is settled?

Answer - We routinely contact your attorney to check on the progress of the case. Since we have a lien position, we do not need to interact extensively with your attorney.

Question - What are Soft Tissue Injuries?

Answer - LFG definition of a soft tissue injury is an injury that is non-surgically treated. A soft tissue is usually treated with light chiropractic non neurologist type treatment. Feel free to inquire how we rate your injury for funding consideration. Soft tissue injuries are the most risky for LFG to advance on. The maximum advance considered for soft tissue is $500.00. Soft tissue also requires a monthly fee of 8.9% compounding with a 5.5 month minimum. As with any advance from LFG, no credit is required or monthly payments. All fees accumulate until settlement of your case. LFG can only consider an advance on a soft tissue injury that is a result of and insured motor vehicle accident. Slip and fall, workers compensation, etc. do not qualify.
